Terms of Service

⚠️ LEGAL REVIEW REQUIRED. This document is a starting draft. Sweepstakes / loot-box / precious-metals retail crosses several regulated domains. Have an attorney experienced in gaming and sweepstakes law in your operating jurisdictions review these terms before publishing — especially the eligibility, fairness, dispute resolution, and arbitration sections.

TL;DR

You open digital “packs” backed by real precious metals. Each pack costs a fixed amount and has a published payout range. Outcomes are determined by a server-side random number generator with audited weights — the same odds we publish in the app are the odds the server uses. You can sell what you pull back to us at live spot price, or ship physical metal of equivalent value to your door. You must be 18+, you can’t use the service from prohibited jurisdictions, and disputes go to binding arbitration.

1. Who can use AurumX

You must:

• Be at least 18 years old.
• Live in a jurisdiction where the service is legal. We do not offer AurumX to residents of [LIST OF EXCLUDED STATES/COUNTRIES — fill in based on legal review].
• Not be on any US sanctions list (OFAC, etc.).
• Pass identity verification (KYC) before shipping any item with a recorded value of more than $10,000.
• Provide accurate registration information and keep it current.

If you don’t meet these requirements, don’t use the service. If we find out you don’t meet them after you’ve signed up, we’ll close your account and refund any unspent balance.

2. Your account

You’re responsible for everything that happens under your account. Use a strong password (or Sign In with Apple). Don’t share credentials. Notify us at support@aurumxgold.app immediately if you suspect unauthorised access.

You can have only one AurumX account. Creating multiple accounts to abuse promotions, evade limits, or otherwise game the system will get all related accounts permanently closed and balances forfeited.

You can delete your account at any time from inside the app (Account → Delete my account). Deletion removes your profile, addresses, and vault contents. Transaction records are retained for 7 years to comply with financial regulations.

3. How packs work

Pricing

Each pack has a fixed price in US dollars. The price, minimum payout, maximum payout, and tier-level odds are shown on the pack card before you open it.

Outcomes

When you open a pack, our server selects an item from the pack’s pool using a weighted random algorithm. The selection is performed in a SECURITY DEFINER database function that:

• Uses cryptographically secure randomness
• Has the exact item weights stored alongside it (we can’t change them mid-spin)
• Records a verifiable result in our ledger before returning to you

We do not adjust outcomes based on player identity, recent history, or any other personal factor. Past outcomes do not change the probability of future outcomes — each open is independent.

What you get

The item shown after your open is recorded in your “vault” with a US-dollar value at the time of pull. You then have three choices:

1. Sell to cash at the live spot price for that metal. Credit appears instantly in your AurumX balance.
2. Keep in vault indefinitely; value tracks live spot.
3. Ship physical metal of equivalent dollar value to a verified address. The metal we ship may be a different specific coin or bar than the one named in the pack — what’s guaranteed is the dollar value in the named metal, fulfilled from our in-stock inventory at the current spot price.

No refunds

Once a pack is opened, it cannot be refunded. The randomised outcome is the product you purchased.

4. Payments and payouts

For now, balances are funded with test credits (whitelisted accounts only). Real-money funding will land in a future update covered by an addendum to these terms.

5. Shipping

Shipments are insured for the recorded value and fulfilled within 5 business days of request. We use [CARRIER — TBD] with signature required on delivery. Title to the metal transfers to you on delivery confirmation. If a shipment is lost or stolen in transit, the insurer reimburses us and we credit your account at the shipped value.

We ship only to addresses in [SHIPPING REGIONS — fill in]. You’re responsible for any import duties or taxes if you have us ship internationally.

6. Acceptable use

You may not:

• Reverse-engineer, decompile, or attempt to extract the open_pack RNG or other server logic.
• Use bots, scripts, or automation to interact with the service.
• Sell, transfer, or assign your account to someone else.
• Use the service if you have a problem-gambling diagnosis or have self-excluded from gambling services in your jurisdiction.
• Use the service to launder money, evade taxes, or for any other unlawful purpose.

Violation gets your account suspended pending review. Repeat or serious violation = permanent closure and forfeiture of balance.

7. Intellectual property

We own the AurumX name, logo, app, website, designs, and code. You get a personal, non-transferable, non-exclusive licence to use the app for its intended purpose. You don’t get to redistribute, mirror, or reverse-engineer the IP.

Once you take possession of a physical shipment, you own that metal outright.

8. Disclaimers

The service is provided “as is.” We make no warranties about uptime, the accuracy of spot prices fetched from third parties, or any specific outcome from a pack open. Spot prices in the app may lag the open market by up to 24 hours; we don’t allow opens against stale data (server rejects with spot_price_stale).

Precious metal prices are volatile. The dollar value of items in your vault can go up or down. Sale prices are pegged to the live spot at the moment you sell.

No financial advice. AurumX is a consumer entertainment / collectible product, not an investment platform.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for:

• Indirect, consequential, special, or punitive damages.
• Losses arising from your inability to access the service due to outages, maintenance, or events outside our control.
• Decisions you make based on information in the app.

Our total liability to you for any claim arising from these Terms or the service is limited to the greater of: (a) the amount you paid us in the 12 months before the claim, or (b) $100.

[JURISDICTION-SPECIFIC CARVE-OUTS — some states (NJ, CA) prohibit broad liability disclaimers for consumer transactions. Add a “Some jurisdictions do not allow…” paragraph after legal review.]

10. Dispute resolution & arbitration

[STRONG LEGAL REVIEW NEEDED HERE. Standard practice for US consumer apps is a binding arbitration clause with a class-action waiver. The exact wording, opt-out window, governing arbitration forum (AAA vs JAMS), and consumer-friendly carve-outs differ by state. Have an attorney draft this section to fit your operating jurisdictions and to remain enforceable.]

11. Changes to these terms

We can change these Terms. If we make material changes, we’ll notify you in-app and by email at least 30 days before they take effect. Continuing to use the service after the effective date means you accept the changes. If you don’t accept them, delete your account before the effective date.
